Terms and Conditions for Ordering.... We will
not process your order til a signed contract is recieved by us via mail. I operate on a first come first serve basis, and
I do not keep a waiting list. This is to be fair to those who are serious about ordering. I am a small operation with 2
children so my order numbers are very limited. All orders are done in design studio by me or one of 6 designers. Your order
will take anywhere from 12 to 16 weeks from the time of placing the order depending upon the design. It is all dependant upon
how full our schedule is when you place your order and what the design is as to when you will receive it.
Unless otherwise
agreed upon!
If you are ready to place an order, simply do the following:
1. Email me your name, address and
phone number in your email and the design you are interested in and if pricing is not present on my site request a quote.
2.
After I have received your request, I will call or email you to discuss details. After we have agreed upon your choice, I
will send you a THIS which you need to review and sign AND MAIL or EMAIL BACK. If you are under the age of 18 it is recommended
that a parent sign the contract for you. I require a minimum 50% non-refundable deposit for any item that I make, which
should be sent back to me with the contract. International Orders MUST "Pay in Full" at the time of ordering. Or rush orders
75% deposit. UNLESS YOU CONTACT ME and I decide otherwise!
3. Send me your measurements in an email or with the contract.
4. After your contract and deposit/payment is received your order is logged and scheduled with one of our 6 designers.
General Order Info
Once I have received the contract with your payment, I will schedule the production of your
item. The average turnaround time is anywhere from 8 to 16 weeks (except for beaded gowns, which require more time), The
amount of time it takes to complete your order is dependant upon how many orders I have ahead of yours and the design you
order. Your order is processed in the order it is received in house. If you need an item in 8 weeks or less, Special arrangements
can be made (see Rush Order Info below).

If
you decide to make any changes to the design of your garment after it has been ordered I.e. Materials, details, embellishments
etc... Then additional fees will apply. Anything that is not part of your original contract is subject to additional fees
and will be determined after we have discussed the changes. An addendum for the changes will be made and sent to you regarding
the changes to your contract and the price change.
Measurements
I will not accept responsibility for inaccurate
measurements. Do to the fact that the garment is custom ordered, it is NOT returnable, but alterations (within reason) can
and will be made to ensure that the client is pleased with the item. However, the client will be responsible for the shipping
charges for the alterations. You are responsible for your own measurements and it is highly recommended that you go to a
professional tailor or seamstress to be measured. We reccomend you work with us in person or allow 6 extra weeks to work
with fitting the item in several shipments.
Rush Orders – READ CAREFULLY!!!!!!!!!!!!
If your regular order
item requires 8 weeks or less to produce then it is considered a RUSH ORDER and incurs a 20% price increase and payment of
the item is due in full at time of ordering. Beaded Gown Rush Orders will incur a 30% rush fee and can only be rushed to
a 4 month (or less depending upon my schedule) production window rather than the normal 6 to 8 month production time window.
Payment in full is due at the time of ordering if you order a beaded gown please be aware of the production time when ordering
and be prepared to wait that amount of time. Keep in mind that I determine if your order is a rush order based upon my schedule
at the time when you contact me. I usually book 6 months in advance.
*Notice* Regular orders will be changed to
a RUSH ORDER Contract if you are late or continuously delayed in getting your measurements, color choices or any design information
needed to complete your order and the delays result in your order ending up having 8 weeks or less of production time. If
this happens then your order is changed to a RUSH ORDER STATUS and you will incur the 20% price increase to your contract.
This additional amount will be due before the item is shipped. This is NOT NEGOTIABLE and by signing my contract you agree
that you understand the rush order terms and fee schedule.

Shipping
All garments are shipped UPS Ground or Priority Mail and are always INSURED in case of
loss unless otherwise decided. This is to protect you as well as me. If you prefer a alternative shipping method please
let me know. Shipping charges will be determined before item is shipped and due with final payment. In the event of loss
or damage in the mail, then one of two actions will be taken. 1. The insurance money shall be recouped and either used to
remake the garment, if time permits or 2. Monies recouped from the insurance will be given back to the customer. This will
be the customer’s choice. International order shipping can be expensive so please be prepared for this. All duties are the
responsibility of the client. I do not pay for your duties and the value of your garment determines how much duties are.
I know nothing about customs.
Payments
Once a garment is completed the remaining balance will be due before
the garment is shipped (this does not apply to international as you are paid in full at time of ordering) unless it is a rush
order which requires payment in full at time of ordering. Forms of payment I will accept are Visa,discover and master card
personal checks, money orders, cashiers checks, International Money Orders and paypal.com (online credit card service).
If you are paying by personal check, money order or cashiers check then the check must clear the bank before the garment is
shipped (this can take up to 7 to 10 days after a check has been deposited, (International Money Orders can take 2 weeks).
You can pay for your item in full at the time of ordering if you so choose. If paying in full, your order will be marked
as paid in full and the only payment due will be your shipping charges. You can also make payments toward your final balance
anytime you like during the production process. I will simply deduct any payment you make toward your final balance.
In
the event of a returned or cancelled check/money order/cashiers check a 30.00 ISF return check fee will be added to your balance.
Valid payment (No Personal Checks) will need to be sent immediately along with the ISF fee. If your payment is returned a
second time you will have 30 days from the date of the last returned payment to send valid payment. If at the end of those
30 days payment is not received then your garment is forfeit to Tracy Lynn Gomez in lieu of payment and any and all payments
made to date are forfeit to Tracy Lynn Gomez. If you stop payment on a check for any reason without letting me know prior
to doing so your order will cancelled and you will loose any and all payments made to Tracy lynn Gomez at that time. You
will also be issued a bill for bank charges I incur due to a stop payment check.

Refunds
Absolutely NO refunds are issued for CUSTOM items. Because the garment is
custom made to measurements you provide there will be NO refunds. THIS IS NOT NEGOTIABLE. NO EXCEPTIONS!
Period
of No Response
If you place an order and I continuously email you and or try and call you with no response month after
month, but your email address and phone number appear to be valid, I will hold your order for up to one year as a valid order.
After one year, I will consider your order "abandoned" and you will forfeit all payments you have made and your order will
be cancelled. It is your responsibility that I have accurate contact information provided at the time of ordering.
Exceptions
Exceptions to the above terms can be made at the sole discretion of Tracy lynn Gomez and will be evaluated
on an order to order basis. If you have a valid reason you need to violate one of the above terms you must contact Making
your dream come true immediately to discuss your specific situation and a determination will be made as to what will be done
at that time with your order.
Acts of God
Sometimes things happen that are completely out of my control i.e.
weather, vehicles breaking down, physical injuries, health and common daily occurrences that can and could hinder the production
of a project. I cannot control everything as I am only human so if your order is delayed due to an "Act of God" I cannot
be held responsible and will do everything in my power to make sure the proper action is taken whether it be file for insurance
if an item is lost, reschedule production of your item should it be damaged, delayed due to materials going on back order
or due to health problems or physical injury. In some cases I may choose to issue a refund if the order cannot be fulfilled
in a reasonable amount of time or meet your deadline but this is done on a individual basis and based upon the time frame
the garment is needed as well as the circumstances surrounding the order at that time.

Fit
It is EXTREMELY important to take accurate measurements! The clothing will be made
according to the measurements YOU PROVIDE. Slight alterations/adjustments will be made free of charge, but any other fit discrepancies
are your responsibility (alterations can be made, but will be at YOUR COST). The fit of clothing varies from era to era and
some are nothing like the fit of modern clothing. Proper undergarments are important to achieving the correct fit of the outer
garments. If you plan on wearing corsets or undergarments that will change your shape you will need to inform me of this at
the time of ordering so I can provide instructions on how to take those measurements.
I would appreciate any photos
in your finished gown, so please send an email with a picture of you in the gown (if possible) and describe what occasion
you wore your gown to. I will in turn post these pictures and comments in my customer gallery.
